Terms & Conditions
These Terms & Conditions explain what you agree to when you use Muslim Myrtle Beach, including browsing the site, creating an account, listing a business, or leaving a review.
Quick summary (not a substitute for reading the full Terms)
Muslim Myrtle Beach is an informational directory and community platform. We are not the businesses listed on the site and we do not guarantee their services or their halal status. By using the site, you agree to use it lawfully, follow our content rules, and understand that you are responsible for your own choices and interactions with listed businesses. Our liability to you is limited, and most disputes must be resolved individually through informal discussion first and, if needed, binding arbitration, rather than court or class actions.
Introduction & Acceptance of Terms
Muslim Myrtle Beach (“Muslim Myrtle Beach”, “we”, “us”, or “our”) operates this website and related online services (collectively, the “Site”).
These Terms & Conditions (the “Terms”) form a binding agreement between you and Muslim Myrtle Beach when you access or use the Site in any way, including simply browsing, creating an account, submitting or managing a business listing, leaving a review, or using any of our tools or features.
By using the Site, you agree to these Terms. If you do not agree, you should not access or use the Site.
Our Privacy Policy describes how we collect and use information about you and is incorporated into these Terms by reference.
Purpose of Muslim Myrtle Beach
Muslim Myrtle Beach is an informational directory and community platform designed to help people discover Muslim-friendly and halal-conscious businesses and resources in and around the Myrtle Beach area.
We are not the owner or operator of the businesses listed on the Site. We do not run their kitchens, shops, staff, finances, hiring, or day-to-day operations. We do not enter into contracts on their behalf, and we are not a party to any transactions you may make with those businesses.
Information on the Site is provided for general informational purposes only and does not constitute professional legal, medical, financial, or religious advice. You are responsible for verifying information directly with the relevant business or qualified professionals.
Eligibility & Accounts
To create an account, manage a business listing, or otherwise use certain features of the Site, you must:
- Be at least 18 years old (or the age of legal majority in your jurisdiction), and
- Have the authority to agree to these Terms on your own behalf or on behalf of the business you represent.
You agree to provide accurate, current information when creating an account and to keep that information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. If you believe your account has been accessed without your permission, you should notify us as soon as reasonably possible at [email protected].
We may, in our discretion, suspend, restrict, or close your account or access to the Site at any time if we believe these Terms have been violated, if we need to protect the Site or other users, or for any other reasonable cause.
Business Listings & Responsibilities of Business Owners
If you submit or manage a business listing on the Site, you represent and warrant that:
- You are authorized to represent the business and to submit information on its behalf.
- All information you provide is accurate, current, and not misleading.
- You will promptly update your listing if key details change (for example, address, contact details, hours, or halal status).
- You and your business comply with all applicable laws and regulations, including licensing, health and safety, advertising, and consumer protection requirements.
You agree not to submit:
- False or misleading claims about your services, halal status, or affiliations.
- Listings for businesses you do not own or have no right to represent.
- Content that infringes any third party’s intellectual property or privacy rights.
We reserve the right (but are not obligated) to review, edit, re-categorize, highlight, or remove any listing or portion of a listing at our discretion, including for clarity, style, or compliance with these Terms and our guidelines.
From time to time, we may label or present listings using terms such as “Featured,” “Verified,” “Highlighted,” or similar, based on our own criteria (which may include, for example, paid upgrades, internal checks, or community feedback). These labels are for informational and promotional purposes only and are not legal certifications or guarantees.
User Reviews & Other Content
The Site may allow users to post reviews, ratings, comments, photos, and other content (“User Content”).
When you submit User Content, you agree that:
- You are solely responsible for your User Content.
- Your content will be truthful and based on your own genuine experience, where applicable, and will not be knowingly false or defamatory.
- You will not post content that is hateful, harassing, discriminatory, obscene, threatening, or that invades someone else’s privacy.
- You will not include private or sensitive information about other individuals without their explicit consent.
- You have the right to grant us the license described below, and your content does not violate any third party’s rights.
You retain any ownership rights you have in your User Content, but by submitting User Content to the Site, you grant Muslim Myrtle Beach a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform that content in connection with the Site and Muslim Myrtle Beach’s activities, including for marketing and promotional purposes.
We may, but are not required to, review or moderate User Content. We may remove, hide, edit, or refuse to display any User Content at any time and for any reason, including if we believe it violates these Terms, is misleading, or is not appropriate for our community, without any obligation to explain each decision.
Paid Listings, Memberships & Other Services
We may offer paid services such as enhanced or featured listings, memberships, or promotional placements (“Paid Services”). The specific features, prices, and terms of each Paid Service will be described on the Site at the time of purchase and may change from time to time.
Unless otherwise stated, fees are in U.S. dollars and are due at the time of purchase. You authorize us and our payment processors to charge your selected payment method for the applicable fees, taxes, and any renewals where recurring billing is specified.
Except where required by law or explicitly described otherwise, all fees for Paid Services are non-refundable. Purchasing or upgrading a listing or membership does not guarantee a particular number of views, clicks, customers, or revenue. It simply provides the visibility or features described at the time of purchase, which may evolve as we improve or adjust the Site.
If a Paid Service includes recurring billing, we will clearly indicate that on the checkout page. You can typically cancel future renewals by following the instructions provided on the Site or by contacting us before the next billing date. Cancellation prevents future charges but does not automatically entitle you to a refund of amounts already paid.
Halal Status & Endorsements
Our intention is to highlight businesses that are Muslim-friendly or halal-conscious. However, information about halal status and other religious or ethical aspects often comes from the businesses themselves or from community feedback.
We do not guarantee that any business is fully halal or compliant with a particular school of thought or standard. We do not perform full-time supervision, certification, or inspection of businesses. Any label, tag, or description on the Site should be treated as informational only.
Having a listing, a certain tag, or a highlighted status on the Site does not constitute an official religious ruling, certification, or endorsement by Muslim Myrtle Beach. Users should confirm details directly with the business and, where appropriate, seek guidance from qualified scholars or professionals.
Acceptable Use & Prohibited Activities
You agree that you will use the Site only in a lawful, respectful way. You may not:
- Use the Site for any illegal purpose or to encourage others to engage in illegal activities.
- Harass, threaten, or abuse other users or businesses.
- Post spam, chain letters, or unsolicited promotional messages using any Site tools.
- Attempt to gain unauthorized access to the Site, other users’ accounts, or any related systems or networks.
- Interfere with or disrupt the operation of the Site, including through automated means such as bots or scripts, except as explicitly allowed.
- Scrape, crawl, or systematically copy content from the Site for the purpose of creating a competing directory or similar service, or to build commercial databases without our prior written consent.
- Misrepresent your identity or affiliation, including by pretending to be someone else or by misrepresenting your relationship with a business.
We may use technical, security, or other measures to protect the Site from abuse. We may limit or block access (including by IP address or region) if we believe it is necessary to protect the Site or other users.
Intellectual Property
The Site, including its overall design, layout, text created by us, logos, graphics, icons, and other original content, is owned by or licensed to Muslim Myrtle Beach and is protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business use, in accordance with these Terms. This license does not allow you to:
- Copy, modify, or create derivative works based on the Site.
- Resell, redistribute, or publicly display significant portions of the Site’s content.
- Use our logos, branding, or trade dress without our prior written permission.
Business logos, photos, and descriptions submitted by business owners remain the property of those businesses or their licensors. By submitting such content, they grant us the license described in the User Content section above so that we can display and promote their listings.
Third-Party Links & Services
The Site may contain links to third-party websites, apps, or services, including business websites, ordering platforms, or social media pages. These are provided for convenience and informational purposes only.
We do not control and are not responsible for:
- The content, availability, or practices of third-party sites or services.
- Any transactions or interactions you have with third parties.
Your use of third-party sites and services is at your own risk and is governed by the terms and policies of those third parties, not these Terms.
Disclaimers of Warranties
To the fullest extent permitted by law, the Site and all content, information, and services made available through the Site are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
Muslim Myrtle Beach does not warrant that:
- The Site will be uninterrupted, secure, or error-free.
- Information on the Site (including listings and reviews) is complete, accurate, or current.
- Any particular business, service, product, or experience will meet your expectations, be safe, or be suitable for your intended use.
To the extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, Muslim Myrtle Beach and its owners, operators, partners, and collaborators are not liable for any:
- Indirect, incidental, special, consequential, or punitive damages;
- Loss of profits, revenue, goodwill, or data;
- Damages or harm arising out of or related to your interactions with any third-party business listed on the Site;
- Damages resulting from your reliance on any content or information on the Site.
To the extent we are found liable despite the above, our total aggregate liability to you for all claims arising out of or relating to the Site or these Terms will not exceed the greater of:
- The total amount you have paid to Muslim Myrtle Beach for Paid Services in the twelve (12) months before the claim arose, or
- Fifty U.S. dollars (USD $50) if you have not paid us anything.
Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you. In that case, the limitations will apply to the maximum extent permitted by law.
Indemnification
You agree to indemnify, defend, and hold harmless Muslim Myrtle Beach and its owners, operators, partners, and collaborators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your use of the Site;
- Your violation of these Terms or any applicable law;
- Your User Content or business listing, including any claim that it is inaccurate, misleading, or infringes the rights of a third party.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.
Dispute Resolution, Arbitration & Governing Law
14.1 Informal Resolution First
Most concerns can be resolved quickly by contacting us. Before filing any formal claim, you agree to first email us at [email protected] with a description of your issue. We will try in good faith to resolve the dispute informally within thirty (30) days after we receive your email.
14.2 Binding Arbitration & Waiver of Jury Trial
If we are not able to resolve the dispute informally, and to the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration, rather than in court, except that either party may bring an individual claim in small claims court if the claim qualifies.
Arbitration means that a neutral arbitrator, not a judge or jury, will decide the dispute. The arbitration will be conducted by a recognized arbitration provider under its rules, and will generally take place in or near the area where Muslim Myrtle Beach is based, unless we mutually agree otherwise.
14.3 No Class Actions
You and Muslim Myrtle Beach agree that each may bring claims against the other only in your or our individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. Unless both you and we agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a representative or class proceeding.
14.4 Optional 30-Day Opt-Out
If you do not wish to agree to arbitration and the class action waiver, you must notify us in writing within thirty (30) days of the date you first became subject to these arbitration terms (for example, the first time you accepted these Terms). Send your opt-out notice by email to [email protected] with the subject line “Arbitration Opt-Out – Muslim Myrtle Beach” and include your name and the email address associated with your account. If you opt out, this Section 14 (arbitration and class waiver) will not apply to you, but the rest of the Terms will continue to apply.
14.5 Governing Law
These Terms and any disputes arising out of or relating to them or the Site are governed by the laws of the State of South Carolina, United States, without regard to its conflict-of-law rules, except to the extent that certain laws may apply regardless.
For any disputes that are not subject to arbitration (for example, certain intellectual property claims or where arbitration is not allowed), you and Muslim Myrtle Beach agree to submit to the exclusive jurisdiction of the state and federal courts located in South Carolina, and you waive any objection to venue in those courts.
Suspension & Termination
We may suspend, restrict, or terminate your access to the Site or any part of it, including your account or listings, at any time and for any reason, including if we believe you have violated these Terms, harmed other users or businesses, or posed a risk to the Site or the community.
You may stop using the Site at any time and may request closure of your account by contacting us. Even after your account is closed, certain provisions of these Terms will continue to apply, including those relating to User Content licenses (for content already used), intellectual property, limitations of liability, dispute resolution, and other provisions that by their nature should continue to apply.
Changes to These Terms
We may update these Terms from time to time, for example to reflect changes in our services, our business structure, or applicable law.
When we make material changes, we will update the “Last updated” date at the top of this page and may provide additional notice on the Site where appropriate. Your continued use of the Site after changes become effective means you accept the updated Terms.
Miscellaneous
These Terms, together with our Privacy Policy and any additional terms or policies referenced herein, form the entire agreement between you and Muslim Myrtle Beach regarding your use of the Site.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing to be effective.
We may assign or transfer our rights and obligations under these Terms, in whole or in part, in connection with a merger, reorganization, sale of assets, or similar transaction. You may not assign these Terms or any rights or obligations under them without our prior written consent.
